Overview

This document describes the agreement made by each applicant when they pay and become a member (all levels) of the Pine Beach Landowners Association. It also provides the Park Rules and Regulations that are part of the agreement, to be followed in order to remain a member of the Association (Pine Beach Park). It is understood that when you sign up and pay to become a member that you legally acknowledge that you have read the rules and regulations in their entirety and that you commit to abide by all the rules and regulations without exception. These rules and regulations can be changed/updated/added to at any time during the membership year as needed.

Agreement as a member

I have read (in its entirety on this page), and understand the rules and regulations. I agree to payment of the fee according to my membership level and to abide by the rules and regulations of Pine Beach Landowners Association (PBLOA).  I understand that failure to abide by these rules and regulations may result in the suspension, revocation and possible permanent loss of being able to apply for membership privileges. If my membership is suspended and/or revoked for any violation of the rules, there will be no refund of fees. I acknowledge that I can read and print these rules from the website at my convenience. I also acknowledge that my signature is not needed to make this agreement binding, only the actions above.

Park Rules and Regulations

  1. Courtesy and Common Sense at all times!
  2. As a member you agree to volunteer to help on at minimum, one of the maintenance days
  3. No Drugs/Alcohol /paraphernalia tolerated. No smoking near the children's playground and beach area
  4. No glass bottles at the Park
  5. There is no pro-rata of fees at any time or for any reason except for earned discounts for volunteering for 3 or more maintenance days.
  6. Gates must remain locked at all times (Even when you’re in the park).  Please do not let anyone in behind you who does not have a key-Ask for it or just lock the gate.  Do not leave the gate unlocked when you leave for anyone or any reason.
  7. Your guests are welcome, with you or a member of your household,  however you are responsible for their behaviour, care and use of the park as per the rules and ensuring they leave when you do. Please do not leave the gate unlocked for any reason. Please immediately email us if there is an issue. The hosting member is responsible for any damage caused.
  8. No Littering. The park does NOT provide garbage disposal, if you bring it in, please take it home.  There are cameras at the Park since last year, we will enforce any violations of any of the rules.
  9. Dogs are permitted in the park subject to the rules and conditions contained below.  Please read them carefully.
  10. Recreational Fires (24” X 24”) are permitted in the fire pit but MUST be properly attended at all times.  The water bucket kept by the fire pit must be kept full and fires must be FULLY extinguished before leaving.  Failure to do so will result in membership revocation.
  11. All children under the age of 14 shall be accompanied by an adult, no exceptions. Unaccompanied children will be sent home and their key taken away.
  12. The beach area and swimming is unsupervised, you are responsible for supervising members of your household of any age who cannot swim or are not good swimmers.  Children are to be supervised in the water at all times. Please bring the appropriate safety equipment with you and we strongly suggest the use of water shoes at all times.  Please use common sense, do not swim if you or your family or guests are ill, have open wounds, do not have safety shoes.
  13. Unless otherwise permitted by approval from the park executive, the park closes at 11:00 PM.
  14. No excessive noise after 10:00 PM or police may be called. If the police is called and non-members are at the park, we have an agreement with the YRP to charge for trespassing on site without our presence. We will uphold the charges.
  15. No overnight camping.
  16. No overnight mooring of boats.  The park takes no responsibility for damage to your boat should you attempt to moor it. Or at any time.
  17. Fireworks are not permitted except at official park events. And only Board members or appointed members by the board are allowed to set the fireworks during an event.
  18. Appropriate behaviour, respect, courtesy and language are expected from all and to all.  This includes children.
  19. Physical and or verbal abuse will not be tolerated from anyone, at any time, and is subject to immediate revocation of membership.
  20. Personal social events are not permitted without approval of the park executive board. Request must be made by email a minimum of 7 days prior to event. (Conditions apply). Parties at the Beach are allowed by permission only!  Please read the Birthday Party rules in the Articles section of the site, applies to any party.
  21. General respect for the property and belongings of Pine Beach LOA is expected and a condition of membership. Any damage or unauthorized alterations to park property will be considered vandalism and appropriate legal action will be taken. The member is subject to immediate revocation of membership.
  22. Copying the Park key is strictly forbidden as well as loaning the key out to non-members, or adding family or neighbors who are not part of your household as members. Failure to abide by these rules will result in immediate membership revocation.  We will be doing random checks at the Park. The gate key (s) and lanyard that are part of your membership remain the property of the PBLOA and have to be returned when requested or in cases of membership suspension or revocation.
  23. If you lose your key and lanyard,  a payment of $10 will be required to get a replacement key and lanyard.
  24. The Pine Beach Landowners Association does not do water testing, each member is responsible to seek information available to them to determine their personal level of comfort with swimming. Swimming is always at your own risk. It is your responsibility to check if the water is safe for your family and your pets.

25. Park members will wear or have visible the lanyard of the keys as identification while they are in the park. As well as park members will be able to show proof of membership from your phone, your membership card and make it available when requested by board members or YRP law enforcement. We also have the right to ask for a legal piece of identification if we deem it necessary.  You are on private property.

26. Membership does not extend to guests of short rental or Air BnB homes.

27. Members accept that their presence in the park provides implied consent to being video recorded for surveillance and safety purposes. Recordings are stored in a secure location, and will be made available to board members and local law enforcement. Surveillance storage will follow all federal and provincial privacy and data storage guidelines. See website Privacy Guideline.

        
Dog Addendum for dog owners

I agree to supervise my dog on leash in the park in my presence, however out of courtesy to other members or small children, I will use common sense in deciding to off leash my dog if it disturbs the enjoyment of other members in the park.  I will not argue whether it is necessary to leash or not, as soon as there is discomfort from others. I WILL put my dog on its leash.  I understand and agree that I accept any and all liability for my or my dog’s behaviour and/or actions and I will hold harmless; the Pine Beach Landowners Association, its executives and from any and all liabilities, injuries, actions, causes of actions, lawsuits and financial penalties of any kind for any reason whatsoever.  I understand and agree that dogs are being allowed in the park on a trial basis and it is critical that safety of all members be first.  I will not allow any other dogs but my own, in my household.  I have been advised that permission for such use may be revoked at any time by a majority vote of the park executive.


RULES FOR DOG OWNERS USING PINE BEACH PARK

    1)    I agree that I will bag and remove any and all dog excrement from the park and take it home with me.  Garbage disposal is not provided at the park. 

    2)   I agree that I will supervise my dog while at the park at all times and make sure they are not a nuisance to other members.

      3)      I agree to have a leash for my dog and I am responsible to ask if others are comfortable if my dog goes off leash or vacate the park on request by any other member who may feel uncomfortable with my  dog or its behaviour. (This is non-negotiable!)

      4)     I agree that permission is granted only for the dog (s) in my household.  Guests are not allowed to bring their dogs.  Pine Beach is not and is not to be used as a Dog Park.

      5)  I agree that dogs are not allowed in the playground, picnic area and in the water when small children are swimming.

        •  I understand and agree that permission for my dog to use the park may be revoked if a violation of any of the above rules should be reported to the Board.  Refusal to abide by such revocation may result in cancellation of my membership without refund.

        Liability Release

        The park is owned via joint tenancy in title by all property owners located within the defined Pine Beach neighborhood and is operated by a volunteer executive on a non profit basis.  In consideration of being granted park membership the member agrees that:   The member and or members heirs and their guests will hold harmless and indemnify Pine Beach Land Owners Association and it’s executive against any and all claims and actions arising out of their use of Pine Beach Park, including without limitation, expenses, judgments, fines, settlements and other amounts actually and reasonably incurred in connection with any liability suit, action, loss or damage arising or resulting from the members use of Pine Beach Park, without limitation. The member acknowledges that given the volunteer basis on which Pine Beach Park is operated and the conditions within Pine Beach Park are subject to change and may represent potential hazards which are beyond the ability of the Pine Beach Landowners Association to control.

        Pine Beach waterfront Park is a private park under a non-profit member association of landowners from Pine Beach Drive to Glenwoods Avenue, west of The Queensway. We do offer memberships for residents out of this area at a higher fee per household.
